GENERAL TERMS AND CONDITIONS OF SALE AND CONTRACT
The Landlord rents to the Tenant the accommodation as described below under the following conditions:
1. OBJECT OF RENTAL
The parties declare that the purpose of this lease is seasonal rental.
Consequently, they agree that their respective rights and obligations will be governed by the stipulations of this contract, by the decree of December 28, 1976 as amended and failing that by the provisions of the civil code.
2. DESIGNATION OF HOUSING UNITS
Villa "Maeltri" (maximum 12 people, approximately 250m²), "Friends" cottage (maximum 6 people, approximately 170m²), "Intimacy" cottage (with or without spa bath, maximum 2 people, approximately 40m²)

3. DURATION OF SEASONAL RENTAL
The Landlord rents the accommodation to the Tenant according to the dates indicated on the booking voucher received upon your registration.
The Tenant undertakes to have completely vacated the accommodations no later than 10 AM .
If there are no other reservations after yours, it is possible to stay a little later in the cottage for €10 per additional hour from 12pm and no later than 4pm.
Only those registered for the reservation may occupy the premises and sleep in the accommodation.
At the start of the rental period, the Landlord will give the Tenant the keys and instructions relating to the accommodation.
4. RENTAL PRICE AND CHARGES
The price is fixed at the time of booking and is shown on the booking confirmation. for the entire duration of the rental. A detailed invoice for payment will be sent to you by email.
This price includes:
For the entire duration of the rental, payment of charges and available supplies as listed below:
- Heating
- Internet access
- Television Access
- water
- electricity
The tourist tax will be payable by bank transfer with the balance of the stay.
The NON-OPTIONAL cleaning fee of €170 for the "Villa Maeltri", €90 for the "Entre Amis" gîte, and €40 for the "Intimacy" gîte WITHOUT a spa bath, will beto be paid either in cash upon arrival, or by bank transfer with the balance of your stay
The same applies to the OPTIONAL linen rental, which will be charged at €10/bed and payable either in cash upon arrival or by bank transfer with the balance of the stay.
Similarly, towels are available for rent as an OPTIONAL item for €7 per person, payable either in cash upon arrival or by bank transfer with the remaining balance of your stay.
For the "intimacy" cottage WITH spa bath included, sheets, towels and cleaning are included in the price.
Fee PER pet : €20 per pet and per stay will be payable upon arrival.
1 pet accepted for the "intimacy" cottage and a maximum of 2 pets allowed for the "maeltri" villa and the "entre-amis" cottage.
Notify the owners before your arrival of the presence of any animals, regardless of the type of animal.
Air conditioning is the tenant's responsibility. There is no air conditioning in the private cottage.
A paid invoice can be issued if the lessee requests it.
5. RESERVATION
The reservation is considered firm after receipt and processing of the 30% deposit payment, pending the balance of your stay.
6. PRICE SETTLEMENT
The balance of the rental will be paid by the Tenant 10 days before entering the accommodation by bank transfer so that this amount is credited to the landlord's account before the Tenant's arrival, or in cash upon arrival.
7. SECURITY DEPOSIT
At the latest, upon entering the premises, the Tenant shall pay the Landlord an amount of 1000 Euros for the villa "maeltri" and the gîte "entre-amis" and 300 Euros for the gîte "intimité", as a security deposit intended to cover damage and/or deterioration of the accommodation, furniture and items filling the accommodation, caused by the Tenant, as well as the loss of keys or items.
This security deposit will be made via a secure Up2pay link which the tenant will receive and must validate to finalize this deposit which will not be debited , but whose bank account must be funded with this amount.
IMPORTANT! The tenant must also ensure that, on the day of arrival, their credit card limit and bank account have sufficient funds to cover the security deposit request via the payment link. If the deposit is declined, they will need to arrange for the cash deposit to be withdrawn to avoid being refused entry to the property.
If a security deposit is not provided, the landlord will be entitled to refuse the tenant access to the property.
The security deposit will be returned to the Tenant within 15 days after their departure, less any sums covering damage and/or deterioration of the accommodation and the furniture and objects in the accommodation caused by the Tenant, as well as any loss of keys, SMD3 card (bins) or objects.
8. ASSIGNMENT AND SUBLEASE
This lease agreement is entered into by the person for the sole benefit of the lessee identified at the head of the agreement.
Any assignment of this lease, any total or partial subletting, any transfer of use—even free of charge—is strictly prohibited. The Tenant may not allow the use of the premises, even free of charge and/or by loan, to any person not named in this contract for the rental of this dwelling, or to any person outside their household.
9. CONDITION REPORT AND INVENTORY
A condition report and an inventory of the furniture made available to the Tenant will be given to the Tenant upon entry into the accommodation.
If the condition report and inventory are not drawn up and signed simultaneously by the Landlord, or their representative, and the Tenant (joint condition report and inventory), the condition report and inventory drawn up by the Landlord alone and given to the Tenant upon entry into the property may be contested by the Tenant within 48 hours of entering the property. If the Tenant does not contest them within this 48-hour period, the condition report and inventory drawn up by the Landlord and provided to the Tenant upon entry will be deemed accepted without reservation by the Tenant.
A condition report and inventory will be drawn up by the Parties at the end of the rental period, each keeping a signed copy.
In the absence of a condition report and/or inventory at the end of the rental period, or if the Tenant establishes the condition report and/or inventory at the end of the rental period alone, the absence of any objection by the Landlord within 5 days following the end of the rental period after the visit of the maintenance team will constitute acceptance of the return of the premises in good condition and/or a complete inventory.
10. LANDLORD'S DECLARATION
The Landlord declares that he owns the accommodation and has free disposal and full enjoyment of it, if necessary, during the period defined in paragraph 3;
If there is no urgent need that requires the landlord to enter the accommodation (suspicion or finding of damage to equipment made by the tenant, water infiltration, major problems or breakdowns of the installations, serious health problem of a tenant or an animal etc...), the owner is required to respect the privacy of the tenants.
11. OBLIGATIONS OF THE LESSEE
-The Tenant shall use the rented accommodation and the furniture and equipment peacefully according to the purpose for which they were intended by the lease and shall be responsible for any damage and loss which may occur during the term of the contract in the premises which he has exclusive use of.
If any items listed in the inventory are broken or damaged, the Landlord may claim their replacement value.
- We remind you that parties are prohibited (loud music, shouting or intense noise, etc.), but on the other hand, normal evenings with family or friends are welcome.
- Access to the sleeping areas (bedrooms and bathroom) is PROHIBITED for our animal friends for health reasons and due to allergies of future arrivals. Any finding of animal hair in the described areas or of allergies of future arrivals will result in a deduction of the deposit of €88.
- FOR ELECTRIC VEHICLES, IT IS STRICTLY FORBIDDEN TO
PICK UP AT THE GUEST HOUSE.
All charges incurred will be billed at €50 per vehicle loaded and per charge.
- Before leaving the premises, the Tenant must empty and dispose of their rubbish in the recycling containers provided for this purpose, and also take responsibility for cleaning the ovens, barbecues and griddles.
- He must avoid any noise that could disturb the neighbors, especially noise emitted by radio, television and other devices.
- The Tenant shall not be able to take any action against the Landlord in the event of theft and damage in the rented premises.
- The tenant must respect the maximum number of people allowed on the premises (2, 6, or 12 people depending on the chosen cottage) as described in the contract. If other people are expected to join the tenants temporarily during the day, the landlord must be informed in advance.
12. CANCELLATION
The signing of the contract is binding on both parties irrevocably. No termination is possible except with the written agreement of both parties.
Tenant's side: If the Tenant cancels the lease, without a serious reason as indicated below and without written and official justification, he remains liable for the full rent.
Only in the event of hospitalization or serious illness, death, or a serious accident preventing travel, is it possible to obtain a cancellation after consultation with and agreement with the owner.
From the owner's perspective: If the accommodation has become uninhabitable (fire, water damage, major breakdown), natural disaster preventing the accommodation of people, emergency work making the accommodation unsuitable for rental, the owner reserves the right either to offer another rental date, or to cancel the rental and refund in full.
13. INSURANCE
The Tenant has taken out comprehensive insurance to protect themselves against rental risks (water damage, fire, etc.) at the time of booking. A copy of the insurance policy will be requested by the Landlord from the Tenant no later than upon arrival at the property.
14. AUTOMATIC TERMINATION
In the event of a breach by the Tenant of any of its contractual obligations, this lease shall be automatically terminated. This termination shall take effect 48 hours after a simple formal notice by registered letter.
15. DISPUTES
This contract is governed by French law.
For the purposes of this agreement, the Landlord and the Tenant elect domicile at their respective residences. However, in the event of a dispute, the court of the Landlord's domicile shall have sole jurisdiction. This agreement and all related matters are governed by French law.
